When you register for the Taking Art website, you agree to the terms of this agreement, and this is re-confirmed every time you visit the website. Please read the agreement carefully.
When you buy anything in the UK a contract is formed between the buyer and seller. It is formed as follows:
- The seller makes an offer to treat. For example, from our website or a verbal price quote, and thereby offering an agreement to abide by the terms and conditions of sale. Nothing is binding at this stage.
- The buyer makes an offer to buy. By doing this you are accepting our terms and conditions of sale and the selling price etc. You may get a confirmation that you order has been received, however this is not an acceptance of your offer.
- The seller accepts the offer to buy or rejects the offer. We may reject the offer, for example, if the price was wrong, the goods are no longer made or if we think the buyer is trying to fraud. Your offer is accepted only at the stage when we produce an Invoice and take payment.
All court actions will be dealt with under UK law and at a court of our choosing close to our locality.
By purchasing from Taking Art Ltd, in any manner, you agree to abide by the terms and conditions in this document.
The delivery estimate appears in “Your Basket” when you select an item, and the delivery estimate refers to the time estimated to despatch the goods from our warehouse. Delivery within the UK should arrive within 2 working days after this.
We endeavour to despatch orders on time and in full wherever possible. However, occasionally an item is out of stock with our Supplier – if this does happen, we will ship what we can, and ship the balance as soon as possible afterwards, unless you specifically request otherwise.
We charge £3.95 for deliveries within the UK.
Please note that customers receiving goods outside the UK may be subject to duty payable in their own Country. You are responsible for any duty owed in this case.
Unfortunately, we are unable to deliver to PO Box addresses.
Customers have the right to cancel an order at any time, for any reason and without liability up until the point when we produce an Invoice and take payment. Simply send an email to sales@takingart.com, stating “Cancellation” in the subject line – please also quote your Order Number.
Taking Art Ltd reserves the right to cancel an order at any time, for any reason, without liability to you or any third party up to the point of producing an Invoice and taking payment. Goods remain the property of Taking Art Ltd until paid in full and we have the right to recover them if necessary.
If for any reason you are not satisfied with your Order, by law, when buying at a distance you are allowed 7 days from receipt of goods in which to change your mind. However, please bear in mind that time and effort goes into processing every Order, and for this reason we ask that customers do not take advantage of this option in order to simply view a product without the intention of keeping it.
If you do wish to return goods, please send them back in good condition, and carefully repacked in the original packaging. Unfortunately, postage costs are none refundable unless the product is not what you ordered, faulty or damaged. You are responsible for your own shipping costs to send products back. You should make sure you use a postal service that can prove we have taken delivery of the goods.
As soon as we receive the returned goods, we will process the refund without delay.
All information provided Taking Art Ltd and its representatives in whatever form or medium is provided free of charge and is accurate to the best of our knowledge. However, no information is guaranteed to be 100% accurate and we do not accept liability should any information be detrimental to yourself or a third party. From time to time errors may occur, and we will do everything in our power, within reason, to resolve them speedily.
Taking Art Ltd reserves the right to change the price and availability of any item as it wishes without liability should it cause you or a third party problems.
In the unlikely event of price increases, or having to substitute an item, we will contact you before proceeding, as your offer to buy is no longer valid.
All images and designs on the Taking Art website are the property of Taking Art or their respective copyright owners, and are used by Taking Art pursuant to express authorisation from copyright owners or their agents.
You are granted permission to electronically copy and print in hard copy parts of the Taking Art website only for the exclusive purpose of placing an Order. Any other use of the contents of the Taking Art website is prohibited without prior consent of Taking Art Ltd.
In the event that any of our members are, or appear to be at our absolute discretion, in breach of any of the provisions of this agreement, Taking Art Ltd reserves the right to suspend or terminate the respective members account.
In the event of any indirect loss or damage, or any loss of data, profit, business or management time, Taking Art Ltd will not be liable to you or any Third Party. Our liability to you due to negligence or otherwise will not under any circumstances exceed £300.
This does not affect your statutory rights as a consumer.
In the event of consequential loss, Taking Art Ltd can only be responsible for the cost of your Order.
Taking Art Ltd is not liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control.
